10/07/2024 - Surrender of Lease to Peter Rabbit Nursery at Sutherland Memorial Park Hall, Burpham, Guildford ref: 3907    Recommendations Approved

Decision Maker: Joint Assistant Director: Assets and Property

Decision published: 12/07/2024

Effective from: 10/07/2024

Decision:

The Council’s tenant, Peter Rabbit Nursery, has agreed to surrender their current lease at Sutherland Memorial Park.

The reason for the surrender of this lease, is so that the Council can then regrant a new licence to them, which will then allow the Council to grant a second licence over the same demise to Burpham Community Hub, when not used by the nursery. The reason this is necessary is that the Council cannot grant to leases over the same area, but can under licence agreements. Leases are only used where the tenant would have exclusive possession.

If you have any queries, then please contact Mark Appleton who will be happy to provide further information.

In accordance with the first schedule of the lease, the annual passing rent of £29,900 has been reviewed as at 31/7/22 and it is proposed to increase it to £34,000.

This accords with the available comparable evidence bearing in mind the terms of the lease. Our consultant recommends the matter is concluded after a period of negotiation.

Decision Maker: Joint Assistant Director: Assets and Property

Decision published: 10/07/2024

Effective from: 10/07/2024

This new sub-lease will grant a new 20 year term, it will also modernise the provisions and contract a new rent of £50,000 p.a. Under Clause 3. (32) of the Head Lease the Council’s prior written consent is required for an under-letting.

This Delegated Authority therefore grants approval for this proposed sub-letting.

28/06/2024 - Council contract with LASER energy for the supply of Gas and Electricity ref: 3889    Recommendations Approved

Our incumbent LASER energy, currently procures energy for over 200 public bodies in the UK, collectively purchasing over £1.5 billion of gas, electricity, and water in 2022 on behalf of 8,500 end users.  LASER have offered the Council an opportunity to join its flexible pricing framework, as long as the Council enter into contracts with LASER before the end of June.

If the Council does not contract with LASER there are limited procurement options available due to time taken to switch suppliers.  It is likely that the Council will see costs rise and be exposed to volatility on the energy markets when trying to procure energy at spot rates.

Decision Maker: Leader of the Council and Lead Councillor for Housing

Decision published: 28/06/2024

Effective from: 28/06/2024

Decision:

2.       Award of a contract for the supply of Gas to the Council via the LASER consortium, for a two-year contract with the option to extend for one further year, worth up to £2,655,000 in total for three years. This will be to the top ranked supplier on the Gas framework – Total Energies.

3.       Delegate authority to the Strategic Director of Place to enter into contractual arrangements on behalf of the Council, in consultation with the Legal Services Manager.

4.       The prices above are consistent with the prices we currently pay and have been budgeted for. There will therefore be no impact on the current budget expectation.
