Decision:
The Council’s tenant, Peter Rabbit
Nursery, has agreed to surrender their current lease at Sutherland
Memorial Park.
The reason for the surrender of this lease, is so that the Council
can then regrant a new licence to them, which will then allow the
Council to grant a second licence over the same demise to Burpham
Community Hub, when not used by the nursery. The reason this is
necessary is that the Council cannot grant to leases over the same
area, but can under licence agreements. Leases are only used where
the tenant would have exclusive possession.

be happy to provide further information.

To approve the reviewed rent of the above
property leased to Kenneth David Buckman.
In accordance with the first schedule of the lease, the annual
passing rent of £29,900 has been reviewed as at 31/7/22 and
it is proposed to increase it to £34,000.
This accords with the available comparable evidence bearing in mind
the terms of the lease. Our consultant recommends the matter is
concluded after a period of negotiation.
A memorandum will be endorsed on the lease recording this
review.

The Yvonne Arnaud Theatre is held by the Yvonne Arnaud Theatre
Trust under a 99 year lease dated 14th July 1961. There is a
sub-lease dated 12th December 2008 granted to Yvonne Arnaud Theatre
Management Ltd. which is the operational company for the
theatre.
Due to changes in the governance structure of the Yvonne Arnaud
organisation it is proposed that the current sub-lease is
terminated, and a new sub-lease is contracted between the (newly
incorporated) Yvonne Arnaud Theatre Trust and Yvonne Arnaud Theatre
Management Ltd.
This new sub-lease will grant a new 20 year term, it will also
modernise the provisions and contract a new rent of £50,000
p.a. Under Clause 3. (32) of the Head Lease the Council’s
prior written consent is required for an under-letting.
This Delegated Authority therefore grants approval for this
proposed sub-letting.

Our incumbent LASER energy, currently procures energy for over 200 public bodies in the UK, collectively purchasing over £1.5 billion of gas, electricity, and water in 2022 on behalf of 8,500 end users. LASER have offered the Council an opportunity to join its flexible pricing framework, as long as the Council enter into contracts with LASER before the end of June.
If the Council does not contract with LASER there are limited procurement options available due to time taken to switch suppliers. It is likely that the Council will see costs rise and be exposed to volatility on the energy markets when trying to procure energy at spot rates.
