Decision:

Volkerfitzpatrick Limited is the contractor employed by GBC to construct Ash Road Bridge.

Volkerfitzpatrick Limited engaged Brett Aggregates Limited to supply some Class 1A aggregates for use by Volkerfitzpatrick Limited in carrying out the construction of Ash Road Bridge. Some of those aggregates were inadvertently contaminated with Japanese Knotweed.

Remediation works have been carried out in relation to those aggregates and Volkerfitzpatrick Limited and Brett Aggregates Limited have agreed to provide a warranty to the Council, together with Surrey County Council and other affected landowners and developers, to cover surveying and (if necessary) treating and/or removing any further Japanese Knotweed arising from the use of such aggregates on site. This warranty will be insurance backed by Environet UK Limited who carried out the remediation works, for a period of 10 years. This warranty is of benefit to the Council.

A mini competition was conducted under Lot 2b Commercial Landlord & Tenant Service – Rent Reviews (Retail). Bidders were asked to price for reporting on the rent review potential, carrying out a formal red book valuation and negotiating with the Tenant to ensure the Council achieves best value.
Scoring was 50% price and 50% technical.
Only 2 suppliers responded to the mini competition – Owen Isherwood and Vail Williams.
After reviewing the 2 responses and assessing their bids, Vail Williams were placed 1st.

The works are to carry out the installation of a non-slip Sika Staircoat Reinforced Waterproofing System to all stairwells & lift foyers on all levels 1 – 7, including the Sainsbury’s link bridge on Levels 5 & 6. The thresholds to the existing steel doors may also need to be adjusted to allow for the new anti-slip coating which is to be applied over the existing floor tiles.

There are three broken corbels which put the structure at a risk of instability and collapse. The repair works are to include concrete and rebar repairs to three locations within York Road. The locations are 2 no. positions on level 5 and 1 no. position on level 7. To repair the corbels an initial temporary and heavy-duty propping system will be required to support the corbels and the surrounding structure whilst the repair works are taking place.

To approve the renewal of the lease of outdoor seating area outside of Rodboro Building to JD Wetherspoon in line with the following terms and conditions:

For grant of a renewal lease the rent will be £5,000pa, which in accordance with the Council’s General Disposal Consent powers, provides the ‘best consideration reasonably obtainable’ where the proposed term exceeds seven (7) years.

The agreed term is 25 years, co-terminus with the Tenant’s lease of the Bar and Restaurant in Rodboro Building. There is a a Landlord break on 6 months’ notice at any time after the 3rd anniversary to allow for the public realm and flood prevention works that the Council propose to the adjacent Theatre Square.

The rent will be payable quarterly in advance and subject to a fixed increase of 7.5% every fifth anniversary.
