The Council’s tenant, Peter Rabbit
Nursery, has agreed to surrender their current lease at Sutherland
Memorial Park.
The reason for the surrender of this lease, is so that the Council
can then regrant a new licence to them, which will then allow the
Council to grant a second licence over the same demise to Burpham
Community Hub, when not used by the nursery. The reason this is
necessary is that the Council cannot grant to leases over the same
area, but can under licence agreements. Leases are only used where
the tenant would have exclusive possession.

To facilitate the use of the premises by two
separate entities, being Peter Rabbit Nursery and Burpham Community
Hub. It is necessary to surrender the lease to Peter Rabbit
Nursery, so two licences can be granted over the same
demise.
The decision meets the policy requirements for
the Council and there were no alternative options
available
